By accessing this application (“Allianz Portal”) and using its contents and services, you acknowledge and agree that you have read and understood the following terms of use and you agree to be bound by them without limitation or qualification. Your use of the Allianz Portal shall be at your own initiative and risk .

The terms “Allianz”, “we”, “us”, and “our” refer to Allianz Malaysia Berhad and its affiliate companies whereas individually the term “AMB” refers to Allianz Malaysia Berhad and “affiliate company” refers to any AMB’s related company or associated company.

USE OF CONTENT, SERVICES AND ACCESS RIGHTS
The content is available for information only. The posting of content and access to the Allianz Portal do not render, either explicitly or implicitly, any provision of services or products by us. Information concerning general or life insurance and health products or services is only available through the respective affiliate company that carries on such business.

If you are an Allianz intermediary, the use of the content, access right and the services available in the Allianz Portal are strictly for business purposes only. Your right to access the Allianz Portal is granted consistent with your agency accountability and responsibility. You agree to hold the information provided with strictest confidence, shall not use it for any other purpose except to carry out the service entrusted to you and shall adhere to the privacy and security policies in the way this information is handled.

CONDUCT OF USER
When using the information and services provided in the Allianz Portal , you agree not to violate or infringe any regulations and laws of Malaysia and the country from which you access this website.

NO OFFER
No information on the Allianz Portal is or should be interpreted as an offer or a solicitation for an offer, as investment, legal, tax or other advice. Where such is needed, an independent professional should be consulted.

NO DUTY TO UPDATE
All content on the Allianz Portal is published as of its date only. We assume no responsibility to update or amend.

COPYRIGHT, TRADEMARKS, SERVICE MARKS AND LOGOS ("MARKS")
The marks appearing on the Alliansymz Portal are the property of Allianz and/or the respective Allianz Group of Companies.
  1. All ownership rights, copyright, trademarks and other intellectual property rights attaching to, contained or vested in the Allianz Portal and all data, information, details, materials, literature, manuals or graphics contained in the Allianz Portal are properties of Allianz and/or the respective Allianz Group of Companies unless otherwise indicated. Allianz strictly prohibits use of its copyright by any means or its trademarks in any manner without express prior consent.
  2. Copying, modifying, displaying, distributing, transmitting, reverse engineering, automated browsing, downloading, commercial exploitation, redelivering through the use of "framing" technology, publishing, selling, licensing, creating derivative works of any contents, materials, information or services available in the Allianz Portal is strictly prohibited, except when it is explicitly permitted by Allianz and/or the respective Allianz Group of Companies.
  3. All intellectual property rights, design and content of the Allianz Portal shall belong to Allianz other than those intellectual property rights of vendors or alliances who have permitted Allianz usage and reproductions of the content in the Allianz Portal

HYPERLINKED AND REFERENCED WEBSITES
Certain hyperlinks or referenced websites on the Allianz Portal may for your convenience forward you to third parties’ websites, which generally are recognized by their top level domain name. Their content has not been investigated or analysed by us, and we do not warrant the adequacy, accuracy, reliability or completeness of any information on hyperlinked or referenced websites. We further do not warrant that the hyperlinks or referenced websites are free from viruses and expressly disclaim any liability for any and all of their content and damages resulting from its use.
By accessing the Allianz Portal , you also agree to abide by the proprietary guidelines set forth at any website accessed or hyperlinked to through the Allianz Portal.

USERNAME AND PASSWORD
To prevent unauthorized access to the Allianz Portal, you have been allocated a username and password for access. To ensure the integrity and protection of your username and password, you are advised to do the following :
  • Do not share your username and password with anyone. You are responsible for all transactions made using your username
  • Do not reveal your password in any way to anyone
  • Do not use simple words (e.g. name, birth date, etc) as your password. Use strong password with at least 8 characters, which consists of numbers, symbols, upper and lower alphabet characters
  • Change your password frequently, at least once every 90 days

INFORMATION SECURITY
Allianz takes reasonable care to ensure that the Allianz Portal is safe and secure, but we do not have control over the computer you use to access the Allianz Portal. You must ensure that your computer does not provide anyone the opportunity to gain access to the Allianz Portal :
  • Always remember to log out of the Allianz Portal and the Allianz website www.allianz.com.my immediately after use
  • Log out of the Allianz Portal and the Allianz website www.allianz.com.my before you visit other websites

DATA SECURITY AND INTEGRITY
Security measures such as data encryption, server authentication and firewalls, combined with our strict information security procedures and policies, are deployed to ensure that you may use the Allianz Portal securely and safely. All information transmitted in the Allianz Portal is encrypted using the 128-bit SSL protocol from Digicert, Malaysia.

COMPUTER VIRUS PROTECTION
The threats posed by computer viruses are real and once your computer is infected, it is costly to you for time loss, loss of important information, etc. The installation of anti-virus software in your computer will help to mitigate this threat.

INFORMATION DOWNLOAD
If you are an Allianz intermediary, the Allianz Portal provide you the ability to download sensitive and confidential information onto your computer strictly for business purposes only. By virtue of the sensitive and confidential nature of the information downloaded, you are required to ensure the following :
  • Secure and protect the information from all third party
  • Implement adequate and reasonable information security procedures to safeguard the information (screensaver activation, password protect, etc)
  • Implement licensed anti-virus software to protect the information
  • Power off your computer when not in use

DISCLAIMER/NO WARRANTY
The Allianz Portal and its content is provided on an “as is” and “as available” basis, without any warranty of any kind, either express, implied or statutory. Allianz specifically disclaims any warranty or merchantability or fitness for a particular purpose, warranty of title, non-infringement of intellectual property rights or third party rights. Allianz shall not be responsible for any virus(es) or worm(s) that you may encounter from the use of the Allianz Portal . To the fullest extent permitted by law, Allianz does not warrant that the Allianz Portal shall be provided uninterrupted or free from errors or that any identified defect will be corrected and that the information on the Allianz Portal is accurate, complete, timely or reliable. Allianz expressly disclaims liability for any delays, errors or omissions in the transmission of content.

LIMITATION OF LIABILITY
We expressly disclaim any liability, whether in contract, tort, strict liability or otherwise, for any direct, indirect, incidental, consequential, punitive or special damages of any character, including and without any limitation, loss of goodwill, loss of use or profits, arising out of or in any way connected with your access or use or inability to access or use the Allianz Portal or reliance on its content, or any failure of performance, interruption, defect, delay in transmission, computer viruses or other harmful components, or line or system failure associated with the Allianz Portal, regardless of our knowledge thereof.

INDEMNITY
You hereby agree to indemnify and keep Allianz fully indemnified against any action, claim, demand or expenses suffered or incurred by Allianz arising from :
  • Your use or misuse of the content in the Allianz Portal provided herein;
  • Your breach of non-observance of the terms and conditions contained herein; and
  • Infringement of rights of any third party in conjunction with your use or access to the Allianz Portal

MODIFICATION OF TERMS
Allianz reserves the right to amend the terms and conditions herein contained at its sole discretion from time to time without notice and it is your responsibility to check for updates. The last revision date for these terms and conditions is set forth below. Any use of the Allianz Portal after such updates shall constitute your acceptance of the amended terms and conditions.

SEVERABILITY
In the event that any of these terms is held unenforceable, the validity or enforceability of the remaining terms will not be affected, and the unenforceable terms will be replaced with enforceable terms that come close to the intention underlying the unenforceable terms.

LOCAL LEGAL RESTRICTIONS
The Allianz Portal is not directed to any person in any jurisdiction where (by reason of that person's nationality, residence or otherwise) the publication or availability of the Allianz Portal is prohibited. Persons in respect of whom such prohibitions apply must not access the Allianz Portal.

GOVERNING LAW AND JURISDICTION
The terms and conditions shall be governed by and construed in accordance with the laws of Malaysia. By accessing the Allianz Portal, you hereby consent to submit to the exclusive jurisdiction of the courts in Malaysia.
